The Pennsylvania Association of Realtors® (“PAR”) will award selected participants of their 2024 Triple Play Giveaway (“the campaign” or “the sweepstakes”) with one prize each being awarded to two (2) eligible participants (two prizes total). The campaign will run from December 9, 2024, through December 11, 2024. PAR reserves the right to stop the campaign at any time prior to December 11, 2024, without notice.

To be eligible for the sweepstakes, individuals must be age 18 or older as of the date of entry. Employees of PAR, their respective affiliates, subsidiaries and their immediate family members and/or those living in the same household of each are not eligible to participate. The sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited. 

Sweepstakes entries are made by completing the form posted on PARealtors.org/triple-play-giveaway/. The entry must fulfill all sweepstakes requirements as described in the rules in order to be eligible. Entries will be accepted online as of December 9, 2024, through the conclusion of the Realtors® Triple Play Convention on December 11, 2024.

PAR reserves the right in its sole discretion to disqualify entries that are incomplete or do not adhere to the rules or specifications. By participating, you agree to be fully and unconditionally bound by these rules and you represent and warrant that you meet the eligibility requirements set forth herein. Only one entry per person will be accepted. Attempts to circumvent the rules or duplicate entries will be considered fraudulent. Fraudulent entries will be removed from eligibility and may disqualify you from the entirety of the sweepstakes. 

Winners will receive an Amazon gift card valued at $50. Winners of the sweepstakes will be selected in a random drawing from the eligible entries received prior to the deadline. The odds of winning depend on the number of eligible entries received. No cash equivalent or other prize substitution is permitted. Any and all related expenses, including any and all federal, state and/or local taxes, shall be the sole responsibility of the winner. Winners will be selected at random from the participating members and the odds of winning depend on the number of eligible entries received. 

PAR’s determination of the winners is final and binding. The winners will be selected no later than December 19, 2024. Winners will be notified via email to the email address on file with PAR within five (5) days of the drawing. PAR shall have no liability for a winner’s failure to receive notices due to the winner’s spam, junk email or other security settings or for the winner’s provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible or fails to respond, the prize may be forfeited and an alternate winner selected. 

In consideration for a prize, the sufficiency of which is acknowledged, you hereby grant PAR, any person or entity acting on behalf of PAR, and its respective licensees, successors and assigns, the right, where permitted by law, without any further notice, review or consent, to print, publish, broadcast, distribute and use, worldwide in any media now known or hereafter in perpetuity, your entry including, without limitation, your name, portrait, picture, likeness, or image as news, publicity or information for advertising, public relations and promotional purposes without further compensation.

PAR reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the sweepstakes should a virus, bug, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Campaign. In such cases, PAR may select the recipients from all eligible entries received prior to the closing of the sweepstakes.

Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, PAR reserves the right to seek damages from any such person to the fullest extent permitted by law. 

By entering, the participant and their heirs or assigns agree to release and hold harmless PAR and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries. 

THIS CAMPAIGN IS GOVERNED BY THE LAWS OF THE UNITED STATES OF AMERICA AND THE COMMONWEALTH OF PENNSYLVANIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this sweepstakes, you agree that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or connected to this sweepstakes, shall be resolved individually without resort to any form of class action exclusively before a court located in Pennsylvania having personal jurisdiction. Further, you agree that in any dispute for whatever reason, the maximum amount of damages owed by PAR will be the equivalent of the value of the prizes awarded ($50) and PAR shall, in no circumstances, be liable for any punitive, incidental or consequential damages, including attorney’s fees. BY ENTERING THE SWEEPSTAKES, YOU EXPRESSLY WAIVE ALL RIGHTS TO (i) CREATE A CLASS ACTION BASED ON THE CAMPAIGN OR THE RESULTS THEREOF; (ii) RECEIVE PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES; AND (iii) BENEFIT FROM STATUTORY MULTIPLICATION OF DAMAGES.
